Dismissal Through Tactical Means

On January 4, 2023, the San Francisco Superior Court ruled in favor of P.K. Schrieffer LLP’s client, granting the firm’s motion for terminating sanctions after having considered the legal arguments made by our own associate, Maxwell Schrieffer. The personal injury matter arose as a result of an alleged slip and fall within an Airbnb rental property. Plaintiff allegedly suffered significant injuries and filed a negligence action in California.

Following a year-long battle involving extensive written discovery and motion practice, Maxwell Schrieffer and his team filed a motion for terminating sanctions given the blatant discovery abuses by Plaintiff and her counsel. After consideration of the issues presented in the motion, the court granted the motion.

Thanks to the hard work of Mr. Schrieffer’s team, the case was dismissed with prejudice and the court awarded monetary sanctions to be paid to P.K. Schrieffer LLP’s client due to the abuse of discovery elicited during the litigation.
